Owners Protective Agent vs Charterers Agent in Bangladesh: Who Reports to Whom

On a voyage charter the nominated agent works for the party that appointed it. What an owner can ask of that agent, and when a separate OPA line is the cleaner choice.

Current-fact control: This article explains planning and agency practice. Port notices, tariffs, drafts, berth/terminal limits, Customs/Immigration routes, carrier acceptance and technical-provider requirements can change. Confirm the current primary-source instruction for the actual vessel, cargo, equipment and date before operational reliance.

On a voyage charter the port agent is usually nominated by the charterer, and the agent's appointment, instructions and account line run to the party that appointed it. An owner who wants a separate line of information appoints an Owners Protective Agent (OPA). The two roles can work on the same vessel at the same time; the difference is who each one reports to and what each is instructed to do.

Who appoints, who instructs, who is paid by whom

The charterer's agent acts within the charterer's appointment. It handles the port call for the party that nominated it, and the principal in its file is that party. The OPA is appointed by the owner or manager, takes instruction only from that principal, and reports only to the recipients the principal names.

Both appointments should be in writing. The OPA instruction should name the represented interest, the nominated agent, the authority limit, the payer, the report recipients and whether physical attendance is included.

What each one holds

The nominated agent holds the port call itself: the arrival notices, the berth or anchorage programme, the authority and terminal contact, and the disbursement account it raises. The OPA does not take that role over. It receives what the nominated agent and the vessel pass on, compares it with its own records and reports the position to the owner.

That is why the OPA's usefulness depends on access. If the owner wants the OPA to review the PDA, the supplier quotations or the Final DA, the written instruction should say which papers the OPA may ask for and from whom.

Where the owner's and charterer's interests can differ

An independent line is most useful where the two sides can read the same facts differently: laytime and delay records, the timing of notices, the cost split of a port call, access or waiting caused by the receiver, and an account line the owner has not approved. The guide to the port call cost split between owner and charterer shows where those cost questions usually arise.

The OPA reports factual differences and open items. It does not decide the commercial outcome, and it does not guarantee berth priority, savings or the result of a claim.

What the OPA does not replace

Survey findings, cargo tally, legal advice, arrest response and claims handling stay with the surveyor, counsel, P&I correspondent or other party responsible for them. If the owner wants any of these attended, that is a separate instruction to the responsible specialist, not a silent extension of the OPA appointment.

Husbandry work is also separate. Where the vessel needs stores, water, cash to Master or crew attendance while another agent holds the call, it can be instructed on its own line without changing who holds the port call.

Keeping both lines workable

Tell the nominated agent that an OPA has been appointed and what the OPA will ask for, so requests are not read as interference. Send the OPA the nomination, the ETA and position updates, the PDA and the NOR and SOF papers as they arise. Agree one report format and one recipient list before arrival, so the owner receives one clear position rather than two competing versions.

For the appointment itself, see appointing an OPA in Bangladesh, which sets out what a written instruction should contain.
