Force Majeure, Strikes and Gate Closures: What the File Must Prove
Congestion, labour stoppage, gate closure and authority restriction are recorded by source, start time, resumption time and operational effect. CPA reports the event and supporting record. Contractual character remains with the parties and their advisers.
CPA does not declare force majeure. The desk records the event, relays notices and keeps the instruction trail. Whether the event meets a charter-party or sale-contract test remains a commercial and legal decision for the parties and appointed advisers.
What helps the later argument
The file should show stoppage and resumption times in the SOF, the obstruction observed locally, the source of the instruction or closure, and the effect on cargo work, stores, crew movement, vessel readiness or sailing. Official notices are retained where available.
Boundary
CPA reports and coordinates. CPA does not certify force majeure, decide notice sufficiency or guarantee a laytime outcome. The principal update states the latest port or terminal position, the evidence received and the revised working forecast.
Social-media reports are not used as SOF evidence. CPA relies on contemporaneous times, responsible-party messages and available official notices, then identifies any gap still affecting the record.
If cargo stops but document work continues, or the reverse, record both streams separately so commercial parties can apply the correct clause later.

CPA requires the relevant charter party or MOA, notices, SOF, invoices, claim correspondence, vessel schedule and P&I or insurer contact. The desk preserves local records and coordinates attendance. Legal advice, security and court action remain with appointed counsel and insurers.
