Sanctions and Dual-Use Screening Before Nominating a Bangladesh Call, Principal Responsibility

CPA acts only on the principal’s screening instruction and approval trail. Local agency appointment does not replace the principal’s sanctions, counterparty, cargo, end-use, banking or export-control review.

Current-fact control: This article explains planning and agency practice. Port notices, tariffs, drafts, berth/terminal limits, Customs/Immigration routes, carrier acceptance and technical-provider requirements can change. Confirm the current primary-source instruction for the actual vessel, cargo, equipment and date before operational reliance.

The local file records the vessel, owner, charterer, operator, shipper, consignee, receiver, end user, cargo description, routing and proposed payment path supplied by the principal. Missing or inconsistent particulars are reported and local action may be held pending the principal’s compliance decision.

Before nomination

A potential list match is escalated under the principal’s compliance procedure. CPA does not resolve the match. Dual-use classification, ECCN determination, license need and licensing remain with the exporter, principal, specialist adviser and competent authority.

Boundary

CPA does not provide sanctions legal advice, clear a party or transaction, certify cargo compliance or guarantee a banking route. The desk reports the operational consequence: nomination held, carrier acceptance pending, bank route unavailable, authority query open or principal approval received.

Incomplete cargo descriptions delay PDA issuance for a reason. The agent should not be asked to invent HS-level clarity the principal has not provided.

Agency funding and paymaster arrangements are checked before urgent port action. If the nominated bank or payment route rejects the transaction, CPA reports the rejection and awaits an approved alternative. Vessel proximity to the pilot does not override the principal’s compliance hold.

Send the relevant charterparty or MOA, notices, SOF, invoices, claim correspondence, vessel schedule and P&I or insurer contact. CPA can preserve records and coordinate local attendance; legal advice, security and court action remain with appointed counsel and insurers.
