Channel Contact and Hull Damage on Bangladesh Approaches, Evidence Before Fault Arguments

Contact in confined waters becomes a claims file within hours. Photographs, pilot records and survey timing matter more than early blame language.

Current-fact control: This article explains planning and agency practice. Port notices, tariffs, drafts, berth/terminal limits, Customs/Immigration routes, carrier acceptance and technical-provider requirements can change. Confirm the current primary-source instruction for the actual vessel, cargo, equipment and date before operational reliance.

Karnaphuli approaches, bar transit and berth contact events require disciplined recording. Early correspondence that assigns fault without evidence weakens the file for every party, including the owner. Preserve evidence early; notice periods and survey practice depend on the fixture and local procedure for that incident.

Preserve immediately

Time, position and pilot status; Photographs of contact points before repair; Deck and engine log extracts; Pilot and tug identification as available; Principal and P&I notification.

Next steps under instruction

Class attendance, underwater inspection or repair quotations proceed only on written approval. CPA coordinates authorised attendances; it does not determine liability and does not perform diving or repair work itself.

Underwater inspection may be required before the vessel sails. That is a feasibility and safety screening exercise, not a routine husbandry add-on.

Avoid speculative fault statements in the first notices. Times, positions and observations travel better into the P&I file.

CPA can preserve local communications, coordinate authorised attendance, track authority or terminal contact and issue a chronology to the appointing principal. The Master retains command responsibility. Nautical causation, liability, security and legal strategy remain with the owner, P&I interests, class and appointed experts or counsel.

Reporting and Responsibility Boundary

Attendance timing matters. Record who instructed each survey, who was present, what areas were accessible and what remained unexamined. If cargo, ballast or vessel position prevented inspection, state the limitation in the same report.

A diver, attending surveyor or class representative may report visible condition. That record should not be rewritten as a final cause finding. Contact point, pre-existing condition, coating loss, indentation, fracture and water ingress require disciplined description and, where instructed, separate expert review.

Separate Condition From Causation

Do not wait for the repair estimate before preserving records. VDR, ECDIS, bridge log, engine log, pilot card, passage plan, soundings, photographs and communications may establish the sequence long before permanent damage is measured.

Channel contact or suspected bottom touch should trigger a time-controlled evidence file. Record the first report, vessel position, course and speed data available to the principal, draft, tide basis, pilotage status, weather, engine or steering status, alarms and the first observed condition.

Open the Evidence File Immediately

Open the evidence file as soon as contact is reported, before any statement about fault is made. Record the time, position and pilot status, photograph the contact points before repair, and take deck and engine log extracts. Note pilot and tug identification where available, and notify the principal and the P&I club.

Keep first notices to times, positions and observations. Notice periods and survey practice depend on the fixture and the local procedure for that incident, so confirm them for the actual event. CPA coordinates authorised attendances on written approval and does not determine liability.

Send the relevant charterparty or MOA, notices, SOF, invoices, claim correspondence, vessel schedule and P&I or insurer contact. CPA can preserve records and coordinate local attendance; legal advice, security and court action remain with appointed counsel and insurers.
